NOTICE: These are the types of issues a foreclosure and bankruptcy lawyer should be prepared to address.   If you are considering hiring a “loan mod company” or “law center” or “attorney-backed” loan modification company, think twice.  Ask if an attorney is actually going to work on your case.  If so, see if the attorney has been practicing real estate law or if they were doing personal injury, DUI, family law, or some other practice that has “dried-up” forcing them into a business they do not understand.  We run across this all the time.  Don’t forget to look for your three year TILA rescission rights, this is getting missed left and right, and where there is an ability to tender, this amounts to professional malpractice if litigation could have been pursued, but was not even addressed.  Also be careful with all the promises of “principal loan balance reduction.”  Foreclosure rescue companies are out there ready to tell you exactly what you want to hear, this is why they are successful.  Once the truth emerges, you are out money and they file bankruptcy.
